In short: In August 2026 FDA released a draft guidance that gives guiding principles for evaluating the quality of container closure systems (CCS) for human drugs and biological products. It is a draft marked “Not for Implementation”, so it is not yet FDA’s final position.
What changed
The draft is issued by CDER, CBER and the Office of Combination Products. The FDA page lists it as a Draft Level 1 guidance under Pharmaceutical Quality/CMC, and the Federal Register notice of availability is dated 14 August 2026 (docket FDA-2026-D-7957). The document says it applies to the packaging of drugs and biological products and also to CCS that are device constituent parts of combination products.
The draft sets out a risk-based framework. From its table of contents:
- General factors: safety of packaging materials, protection, performance, effects of the manufacturing process, and storage and handling.
- Risk considerations by dosage form: inhalation, intranasal, injectable, transdermal and transmucosal, topical, ophthalmic and otic, and oral products.
- Quality assessment and control: description, suitability evaluation, quality control, stability testing, and extra tests for shipping, handling and storage.
- Secondary and auxiliary packaging components, packaging for device constituent parts, and bulk containers.
- What CCS information goes into marketing applications, investigational applications and master files, and how to report postapproval changes to a CCS.
Like all FDA guidance, it is non-binding. The draft itself says it represents FDA’s thinking only once finalised.
Who it affects
Companies that file or hold US applications (NDA, ANDA, BLA, IND, drug master files) and the QA, QC, packaging-development and regulatory-affairs teams who select packaging, run extractables and leachables or integrity work, and write CMC sections.
Key dates
- 14 August 2026: Federal Register notice of availability.
- Comments: the draft states they should be submitted within 90 days of publication of the Federal Register notice, through regulations.gov under docket FDA-2026-D-7957.
What to do now
- Read the dosage-form section that matches your products and the “Suitability Evaluation” part of section V.
- Compare your current packaging qualification files with the draft’s list of assessments. This is an example in-house approach: build a simple matrix of each packaging component against safety, protection, performance and stability evidence.
- Tell regulatory affairs if your products are combination products, since the draft has a separate section for device constituent parts.
- If your company wants to comment, plan it before the 90-day period ends.
